1. Introduction

• Local Installation: Each game or mod is downloaded and installed as a standalone application on your local device.
• Direct Integration: Streaming platform connections (such as TikTok LIVE) are established directly within each individual downloaded game or mod executable, rather than through a single master web dashboard.
• Third-Party Compliance: You are solely responsible for ensuring that your use of downloaded games and mods complies with all applicable rules, policies, and terms of connected services (including TikTok), as well as third-party game publishers whose games you are modifying.
• Independence: TOSGames and FromTechMap are independent software developers and are not affiliated with, endorsed by, or sponsored by TikTok, ByteDance, or any third-party game publisher unless explicitly stated.

3. Eligibility

By using the Platform, you represent and warrant that:

• You are at least 13 years of age (or the legal minimum age in your jurisdiction).
• If you are under 18, your parent or legal guardian has reviewed and agreed to these Terms and supervises your use of the Platform and downloaded software.
• You meet all age and eligibility requirements set by connected streaming platforms (such as TikTok) regarding live broadcasting, receiving gifts, and interactive monetisation features.
• You are legally able to enter into binding agreements or have valid legal guardian consent.

4. Account Registration & Software Licensing

Account Credentials: To purchase, license, or download certain games or mods, you may be required to register an account on tosgames.com. You must provide accurate information and maintain the security of your login details.

License Grant: Subject to your compliance with these Terms and payment of any applicable fees, TOSGames grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and run individual games and mods for personal or streaming use.

License Restrictions: You agree not to reverse engineer, decompile, disassemble, crack, bypass license verification checks, resell, or distribute standalone game executables or mods downloaded from our Platform without prior written consent from FromTechMap.

5. Privacy, Stream Data, and Viewer Interactivity

When running interactive games or mods linked to your live stream (e.g., TikTok LIVE):

• Local In-Memory Processing: Stream interaction events (such as live chats, gifts, likes, and viewer names) are processed locally within the game runtime to trigger in-game mechanics.
• Broadcaster Responsibility: You are responsible for providing appropriate notices to your viewers regarding stream interactivity and ensuring your broadcast complies with applicable privacy, consumer, advertising, and streaming guidelines.
• In-App Inputs: Hotkeys and local controller inputs are processed strictly on your local device and are not recorded or transmitted to our web servers.

6. Plans, Payments, and Refund Policy

Payment Gateways: All payments, subscriptions, or license purchases for games and mods are processed through secure third-party payment gateways: Flouci and ClickToPay.

Payment Terms: You agree to provide valid billing information. Card details are processed directly by Flouci or ClickToPay under their respective policies. TOSGames does not collect or store full credit card or banking details.

Refund Eligibility: We want you to be satisfied with your purchase. You are eligible for a full refund on downloaded games or mods if both of the following conditions are met:

• Timing: The refund request is submitted to [email protected] within 14 calendar days from the original payment date.
• Usage: The game or mod application has been run or used for less than 2 hours in total.

Non-Refundable Scenarios: Refund requests made after 14 days, software used for 2 hours or more, or accounts suspended due to violations of these Terms, software piracy, or cheating are non-refundable.

Payment Disputes: If a payment is disputed, charged back, or flagged as fraudulent, we reserve the right to revoke software licenses and suspend your account access.

7. Base Game Ownership & Third-Party Mods

Base Game Requirement: Certain game modifications ("mods") available on tosgames.com require a legally acquired, licensed copy of a third-party base game (such as Grand Theft Auto V or other publisher titles) to function.

User Responsibility: You represent and warrant that you own a valid, legal license for any base game required to run our mods. TOSGames does not provide, host, or distribute pirated or unauthorized copies of third-party base games.

Publisher Terms: You acknowledge that using mods in third-party games is done at your own risk. You are responsible for complying with the End User License Agreements (EULA) and terms of service set by the respective base game publishers.

8. Intellectual Property & User Content

Termination: We reserve the right to suspend or terminate your account or revoke software licenses without prior notice if you violate these Terms, engage in piracy, or breach third-party platform rules.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM, WEBSITE, DOWNLOADABLE GAMES, AND MODS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TOSGAMES AND FROMTECHMAP DO NOT GUARANTEE THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH ALL THIRD-PARTY GAME UPDATES OR STREAMING PLATFORM API CHANGES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FROMTECHMAP, ITS FOUNDERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, STREAM REVENUE, DATA, OR ACCOUNT SUSPENSION ON THIRD-PARTY PLATFORMS ARISING OUT OF OR RELATED TO YOUR USE OF OUR GAMES, MODS, OR WEBSITE.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Tunisia. Any disputes arising out of or in connection with these Terms or the use of tosgames.com that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the competent courts of Tunisia.

• Instant Digital Delivery: All software, licenses, and digital goods purchased on tosgames.com are delivered exclusively via instant digital download. Upon successful payment confirmation, you receive immediate access to download the software or activate your license key.

2. Payment Methods & Processing

All purchase transactions on the Platform are securely processed through authorized third-party payment gateways:

• Flouci (for national and international bank card payments)
• ClickToPay

By completing a purchase, you confirm that you possess full legal authorization to use the selected bank card or payment account.

3. Cancellation, Return, and Refund Policy

Purchases of digital software and licenses are eligible for a full refund only if both of the following conditions are met:

• Timing: The refund request is submitted in writing to [email protected] within 14 calendar days from the original transaction date.
• Usage: The downloaded game or mod application has been run or used for less than 2 hours in total.

If a refund is approved, it will be processed through the original payment gateway (Flouci or ClickToPay) in accordance with applicable banking procedures and network processing times.

4. Applicable Law and Jurisdiction

These Terms of Sale and any purchase agreements made through tosgames.com are governed by and construed in accordance with Tunisian Law.

In the event of any dispute, claim, or disagreement, the user agrees to first contact Fromtechmap ([email protected]) to seek an amicable solution. If an amicable settlement cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Tunis, Tunisia.
